Australian man fined for tickling shop assistant

A Sydney man who tickled a female shop assistant under the chin while calling her a 'lovely thing' has been slapped with a $750 fine.

Southport Magistrates Court was told Wayne John Boyd, 27, from Sydney, had an 'all-nighter' and was drunk when he walked into the Wild Orchid clothing store in Surfers Paradise and approached Kathleen Gleeson.

Ms Gleeson told police she felt intimidated by Boyd, who had entered the shop with another man and 'stood in her personal space'.



Prosecutor Sergeant Warren Murdock told the court Ms Gleeson was backed into a corner by Boyd, who then put the palm of his hand under her chin and with a menacing gaze said 'You lovely thing'. "The victim did nothing to invite his attention," said Sgt Murdock.

Boyd was arrested and spent five hours in the Southport Watchhouse before being bailed.

The court heard the incident took place in March 2005 and the court delay was due to failed attempts by Boyd to apologise to the woman through mediation. Yesterday, Boyd pleaded guilty to one count of common assault. His solicitor, Jason Jacobson, said there was no dispute the attention from his client was unwanted and unnecessary.
