Lawsuit Filed After Bizarre, Deadly Accident

New legal action is opening old wounds for a woman who lost her husband in a bizarre crash. He was behind the wheel in an accident that injured several students at a Montgomery County girls school.

The freak accident happened along the Pennsylvania Turnpike and it was caused by a low flying goose, claiming the life of Donald Polce.

"The driver was not exceeding the speed limit, this accident occurred because the large goose struck the windshield and then struck the driver in the face," said Sgt. Robert Fosse of the Pennsylvania State Police back in May 2004, when the accident occurred.

Eight high school girls survived the accident, who were students of Marie Polce. Marie was at the time, a teacher at the Baldwin School on the Main Line.

Donald was driving the girls back from a science fair at Penn State.

"We needed a driver and Donald volunteered," said Marie.

Donald also signed himself for the rental van at Bargain Rental in Broomall. The company has decided to file a civil suit against Donald's widow, two years after the accident.

The attorney for the rental company admitted by phone that it was a horrible tragedy but he said his rental company has been without a van for more than two years.
