Marsinko says since the card was printed, people have made inappropriate comments to him. He says the comments have caused him to suffer in many ways.

According to Marsinko, the picture was taken at the State Fair of Virginia in 1996. He says he never gave his consent for the photo to be used for commercial purposes. Marsinko's attorney says the complaint was filed in Roanoke County Court because the greeting cards were purchased there, among other places.
