A Longmont woman was arrested on Wednesday on suspicion of drugging and sexually assaulting a man with whom she had a consensual sexual relationship. Janice McCarl, 53, appeared briefly in court at the Boulder County Jail on Thursday for a bond hearing. She is being held on suspicion of felony sexual assault and is scheduled to return to Boulder District Court on Feb. 3 for filing of charges.
According to police reports, she apologized to the 50-year-old man in a note left on his door after he reported the assault to police. “I just want you to know that I am very sorry for what I have done. I’ve disrespected and degraded you,” the affidavit quoted the note as reading.
The man told police Dec. 10 that McCarl drugged him, waited for him to fall asleep, and then used her hand to penetrate him anally. He told police that he briefly awoke and she cajoled him to go back to sleep. He believed the assault happened about a month prior to his report to police, during a cookout at his Longmont home. He said he invited McCarl for dinner and considered her a friend with whom he was sometimes sexually intimate.
The man told police he suspects McCarl used sleeping pills to incapacitate him, and he suffered severe abdominal pain in the days after the incident. Their sexual relationship resumed after he confronted her about the assault and he said she admitted it and apologized, according to an arrest warrant affidavit for her.
“He said she made the comments, ‘Did I break you?’ and ‘Did I drug you and rape you?’” according to the affidavit released Thursday.
He told police he continued to have sex with her after the assault but did not allow her to sleep in his house because he no longer trusted her. He said he maintained the relationship to make sure “justice” would be served.
