Judge grants mother's request to take dead son's sperm

The mother of the 21-year-old that died after an attack in Austin Texas wants to preserve her son's sperm to have a grandchild through a surrogate mother.

A Travis County judged signed an order on Tuesday afternoon granting Marissa Evans her wish, requiring medical examiners to preserve her son Nikolas Evans' body until the specimens can be taken.

According to court documents, Marissa Evans said her son expressed his desire to have children on numerous occassions and had already picked names for three sons: Hunter, Tod and Van.



"I am asking the court to intervene on Nikolas's behalf to preserve the legacy that he desired," Marissa Evans said in an affidavit.

Nikolas Evans died on Sunday after spending more than a week in intensive care from injuries sustained in an attack on 6th Street early in the morning on March 27.

Marissa Evans did agree to donate her son's organs, which, according to reports, stipulates Nikolas Evans remained on life support until 9 p.m. on Monday. For the specimen to be of use, it must be collected within 24 hours after death, or the body must remain at less than 4 degrees centigrade.
