A man caught frolicking naked with his girlfriend in a neighbour's paddling pool has been prosecuted after demanding back a photograph of the incident. Daniel Finch's neighbour thought he and his girlfriend were about to have sex in the pool – and took the photograph as evidence to show Finch's mother.
Finch later threatened to kick down his neighbour's door in Clifton and take the camera from her. He was given a community order at Nottingham Magistrates' Court after pleading guilty to using threatening words or behaviour likely to cause alarm, harassment or distress.
Paul Hughes, prosecuting, told the court: "This defendant was in the paddling pool naked and his girlfriend was naked from the waist up. They were making a large amount of noise in the rear garden.
"After being confronted the defendant and his girlfriend left the garden, but later the defendant came back and kicked the front door. He was shouting and swearing and threatening to kick the door in and take the camera so he could get his hands on the photograph."
When interviewed by police, Finch, 29, denied that he had intended to have sex in the pool, saying he took his clothes off as he didn't want them to get wet.
Magistrates gave him a new community order for 12 months, during which he will be supervised by the Probation Service, and will have to do 150 hours of unpaid work. He was also ordered to pay £70 towards legal costs.
