An alleged rapist with a severe case of haemorrhoids had his trial adjourned so his lawyers could find him a special cushion to sit on. Despite the judge ordering a member of the man's defence team to buy a piles cushion from a nearby branch of Boots, the hearing was adjourned after it was revealed the item required was a 'niche' product that could not be easily obtained.
The defendant was last year diagnosed with third degree prolapsed haemorrhoids while in prison, which needed further medical treatment before the beginning of the trial. His trial was due to begin yesterday at Southwark Crown Court but the proceedings were adjourned until today. Southwark Crown Court was told the man's defence team had visited a number of pharmacies - including one attached to a nearby hospital - in a bid to find the cushion.
However, they were unable to find one. In a submission to the court, the man's barrister said: 'The item is a specialist niche item. One has been ordered, with a pick-up time of between 3.30pm and 4pm this afternoon. Regrettably, we need to make an application that the Crown don't open their case until matters have been resolved.'
The prosecution did not oppose the request to delay the opening of what is expected to be a short trial. The judge said: 'Well with some reservations, I understand the position. Justice must be done and seen to be done, and bearing in mind the time estimate. I am prepared to accede to the unopposed application by the defence and to adjourn the trial until tomorrow.'
