Carter claims he was standing on a public sidewalk in the Brooklyn's Crown Heights neighbourhood on June 12, 2011 when several of New York's Finest approached him "without provocation" and "strangled the plaintiff about the neck, placed a drawstring around his penis, and strangled his penis, causing bodily injury."

He says an officer or officers continued to assault him as he sat on a bench. And he says they falsely charged him with "consumption of alcohol on a public street," though "there was not a scintilla of credible evidence" of this.
He seeks damages for false arrest, unjust imprisonment, malicious prosecution, assault and battery, civil rights violations and emotional distress.
