Man & Dog Drop Nude Sunbathing Suit

A former bodybuilder who sued for the right to sunbathe nude with his dog at his side has dropped the lawsuit, citing poor health.

Mark DelCore said in the suit filed in federal court in Central Islip that he needed his dog, Cheekies, with him because he suffers from post-traumatic stress disorder.

DelCore said sunbathing is a balm for a skin condition he developed after exposure to World Trade Center toxins while leaving a lower Manhattan gym.

DelCore favored sunbathing at a "clothing optional" beach at the Fire Island National Seashore, which allows only guide dogs on its swimming beaches. In his lawsuit against the park, DelCore said his dog's healing presence qualifies the animal as a "service dog."

But in a letter Monday to U.S. District Judge Joseph Bianco, DelCore said that he did not "possess the stamina or physical continuity necessary to continue this complaint."
