Police Say Drunk Driver Was Five Times The Legal Limit

Virginia Beach police have charged a 24-year-old woman with drunk driving, noting in court records her blood-alcohol concentration was 0.44, or five times greater than the legal limit. At that level, according to pharmacology experts, a person is approaching death.

According to police records and witness interviews, Ashley Faith Atwell passed out in broad daylight behind the wheel of a $50,000 BMW at the intersection of South Plaza Trail and South Independence Blvd.

Anita Cosby, a driver who called 911 while following the BMW, said Atwell lapsed into unconsciousness with her car in drive and her foot on the brake. Police Officer Kevin Lokey put his car in front of Atwell's so the idling luxury sedan did not roll into the intersection.

In a search-warrant affidavit for Atwell's medical records, Lokey wrote: "She was moving inside the vehicle, turning the windshield wipers on, sounding the horn and spraying us with the windshield washer fluid. Ms. Atwell had also defecated on herself."
